US Appeals Court Backs Ban on Certain For-Profit College Tactics

Bloomberg – A US Appeals Court upheld a 2011 decision by the US Department of Education to ban for-profit schools from offering bonuses to recruiters based on the number of students they enroll. Judges said the department’s decision was in keeping with the 1965 Higher Education Act, but ordered lower court judges to examine the effect the ban could have on minority student enrollment. The court left open the possibility that recruiters could be paid bonuses if students completed the program. The Department of Education’s argument says that bonuses for enrolling students encourage recruiters to use high-pressure tactics and encourage student loans.
